BIDDERS: By placing a bid at the Auction the bidder is publicly acknowledging that they have read, understand and agree to this opening statement and these terms and conditions and are completely satisfied with the condition of the property, without reservation that is being sold at Auction. By placing a bid at the Auction, the bidder is stating publicly that they have cash or a good check to pay for the property and they are buying at the Auction and will have a ten percent deposit onsite on the day of sale. The buyer at the Auction agrees to waive their rights to any further inspections of the property and acknowledges that we are selling the property in “As Is “condition with any and all faults that may or may not exist. AUCTION FORMAT: This is a Jefferson County Probate Court Ordered Auction case #2017-13-570. The court has appointed Frank Herndon, Jefferson County Clerk as Special Commissioner for this sale. There is not a reserve price that has been set for this sale however the final price and terms of the sale must be approved by the Jefferson County Probate Court Judge and the court reserves the right to accept or reject the final auction contract. The home, all out buildings, both lots and all personal property onsite will be sold as one collective auction lot to the highest or best bid subject only to these terms and conditions.
PUBLIC AUCTION: This is a public auction, and everyone is welcome to bid. All Bidders must register with Jackson Real Estate and Auction and obtain a bid number. Absentee bids are welcome provided that the bidder has registered in advance and has paid a deposit equal to 10% of the final selling price reflected on the contract. All deposits exceeding the 10% deposit will be adjusted and credited to the Buyer at closing.
BUYERS PREMIUM: There will be a 10% Buyers Premium charged to the successful bidder. The buyer’s premium will be added to the buyers bid to determine the final contract price.
TRANSFER BY CLERKS DEED: This property will transfer by a clerk’s deed and will be signed by Frank Herndon, Special Commissioner and Clerk of Jefferson County, TN.
PROPERTY: We will be selling this 3-bedroom, 1 bath home located at 1422 Fina Lane, Dandridge, TN 37725 and the adjoining lot number 6. The home and property are in the Clarence and Ethel Reneau Subdivision and is recorded in Plat Book 7 Page 21 or Plat C Page 157 in the register of deeds office, Jefferson County, TN. All personal property that is in and about the property will transfer to the buyer of the property per the court order. According to the Jefferson County Tax Assessors office the home has approximately 1336 square feet.
SEPTIC DISCLOSURE: Neither Jackson Real Estate and Auction nor the estate has any records as to the capacity or layout of the septic system. Our 3-bedroom description is based on visual bedrooms and not the actual capacity of the system. There is no warranty or guarantee of any kind either expressed or implied as to the suitability of the septic system.
SURVEY: Surveyor Billy Knight has completed a new survey of the property and copies of that survey are online and will be at the Auction.
UTILITIES: Dandridge City water and Appalachian Electric.
LEAD BASE PAINT DISCLOSURE: ALL prospective buyers are given a 10-day opportunity prior to sale date, beginning on December 13, 2019 to conduct a risk assessment or inspection of the premises for the presence of lead base paint hazards. Regardless of the findings of the Buyer, by bidding at the Auction all prospective buyers are waiving their rights to conduct any further inspections of ANY portion of the property or the buildings and agree in advance to accept the property in its current condition. It is estimated per the tax records that this home was built around 1973. Lead Base Paint Notices apply to all homes built prior to 1978.
TITLE ATTORNEY: Attorney Larry Churchwell has checked title to the property. A copy of the Attorneys Preliminary Report on Title is available online and will be at the Auction for review. The title company is Jefferson Title, 865-397-9428 and their office is located in Dandridge, TN. Title insurance is available upon request. Tracy Monroe will be the closing agent for the title company.
PROPERTY TAXES: All property taxes that are owed will be paid current up to the day of closing including all back taxes. If this home closes in 2019 the 2019 taxes will be prorated. If the home closes in 2020 the 2019 taxes will be paid by in full by the estate and the 2020 property taxes will be prorated up to the day of closing.
DEPOSIT REAL ESTATE: Successful bidders on the real estate will make a 10%, non- refundable deposit on day of sale in the form of cash, personal check, or certified funds and sign a personal note payable to the auctioneer for the amount of the contract. The note shall become null and void at the successful closing of the transaction.
CLOSING DATE: The projected closing date of this auction will be on or about January 27, 2020. Since this sale must to be confirmed by the court it is unknown at this time what day the court will meet to review the contract. Special Commissioner Frank Herndon and Jackson Real Estate & Auction reserve the right to extend the closing date as needed, not to exceed 60 days to allow the court time to review and confirm the sale. In the event that the court does not confirm the sale and or a new agreement cannot be ratified with the Buyer per court orders then at that time the Buyers deposit can be returned to the Buyer and the contract will be deemed null and void.
CONTRACT EXTENSION or ASSIGNMENT REQUEST: In the event the Buyer requests a contract extension on the closing date or an assignment of the auction contract to another party then that request shall be in writing to the auctioneer and must include a $500 review fee (non-refundable) to Jackson Real Estate & Auction with no guarantee that an extension can be granted unless all the parties, such as but not limited to the Special Commissioner, the Attorney, the Judge and the Auctioneer agree to extend or grant the request.
